How Does Mediation Work?
A mediator is a third-party, trained professional who can moderate discussions and intervene when necessary. They ensure each party has a chance to speak without interruption, and can ask clarifying questions to get to the source of the dispute. A mediator is neutral and doesn’t work for either party, but rather with both parties. They cannot give advice to either party, but instead gently lead them through the process of freely exchanging information and formulating solutions on their own.
Mediation is a flexible and confidential way to come to an agreement about the terms of your divorce, child support and custody, property division, spousal support, and any other issues that need to be resolved before your case can be finalized. Mediation is completely voluntary and can last as long as is necessary to resolve your disputes.
Benefits of Mediation
Litigation can take a significant amount of financial resources to pay for legal representation, court costs, and other expenses associated with resolving your family law case in court. At the end of the court proceedings, what the judge orders will be the final say, whether or not you like the answer. Litigation is often very stressful for everyone involved since there is little control over the outcome of your case. You also are tied to the court’s schedule, which means your case may drag out for weeks or months.
Mediation, on the other hand, gives you far more control over the outcome of your case. The process generally costs significantly less than litigation, as you are only paying for the mediator’s services. Because of the flexible nature of mediation, you can also resolve your issues on your schedule, which can help reduce the amount of stress and financial strain felt by families. Mediation is also a hands-on approach to family law disputes, which allows the involved parties to have far more control.
